These Terms of Service (the "Terms") govern access to and use of Calibra, including the Calibra mobile application, website, and related services (collectively, the "Service"). The Service is operated by Calibra Software LLC, an Oregon limited liability company ("Calibra," "we," "us," or "our").
By downloading, accessing, or using the Service, you agree to these Terms and our Privacy Policy. If you do not agree, do not use the Service. If you use the Service on behalf of another person or organization, you represent that you have authority to accept these Terms on their behalf.
Calibra is a personal reflection and self-evaluation tool designed to help you find your bearings, notice patterns, and make intentional adjustments. It is a navigation instrument for personal steering — not a clinical tracker, medical service, therapist, emergency service, or substitute for professional advice.
Calibra does not provide medical, mental-health, legal, financial, or other professional advice. Do not use the Service to diagnose or treat a condition, make an emergency decision, or replace qualified professional care. If you may be in immediate danger or need urgent help, contact local emergency services or an appropriate crisis resource.
Features may change over time. We may add, modify, suspend, or discontinue features, subject to applicable law and any rights you have under these Terms.
You must be at least 13 years old, or the minimum age required to use online services in your country, whichever is higher. The Service is not directed to children under 13.
Some features may require an account. You agree to provide accurate information, keep your credentials secure, and promptly notify us of unauthorized access. You are responsible for activity conducted through your account unless the activity resulted from our failure to use reasonable security measures.
You may request account deletion through the in-app account controls or by contacting hello@usecalibra.com. Account deletion may permanently remove associated data, subject to our Privacy Policy and legally required retention.
The Service may allow you to enter reflections, check-ins, notes, goals, ratings, and other material ("User Content"). You retain ownership of your User Content.
You grant Calibra a limited, worldwide, non-exclusive license to host, store, process, reproduce, and display User Content only as reasonably necessary to provide, secure, maintain, and improve the Service, and as described in our Privacy Policy. This license ends when your User Content is deleted, except to the extent retention is required by law, necessary for legitimate security or backup purposes, or otherwise permitted by the Privacy Policy.
You are responsible for your User Content. Do not submit content that you do not have the right to use, or that contains another person's private information without appropriate permission.
Some features may use automated or AI-assisted systems to generate reflections, summaries, prompts, or other responses. These outputs may be incomplete, inaccurate, generic, or inappropriate for your circumstances. You are responsible for evaluating outputs before relying on them.
Do not treat an AI-assisted output as a diagnosis, professional recommendation, prediction, or statement of fact. Do not use it as the sole basis for decisions involving health, safety, finances, legal rights, or another person's welfare.
You may use the Service only for lawful, personal purposes and in accordance with these Terms. You may not:
If we offer paid features or subscriptions, the applicable offer screen will identify the price, billing period, renewal terms, and any trial or introductory offer before you purchase. Unless otherwise stated, subscriptions automatically renew until canceled.
For purchases made through Apple's App Store or another app marketplace, billing, cancellation, and refunds are handled through that marketplace under its applicable terms and policies. You can cancel an auto-renewing subscription through your marketplace account settings. Canceling prevents the next renewal but generally does not refund the current billing period, except where required by law or the marketplace's refund policy.
We may change prices or paid features prospectively. Where required, we will provide advance notice and obtain any consent required by law.
The Service, including its software, design, visual language, text, graphics, trademarks, logos, and other materials, is owned by or licensed to Calibra and protected by applicable intellectual-property laws. Except for the limited right to use the Service under these Terms, no rights are granted to you.
"Calibra" and related marks are trademarks or service marks of Calibra Software LLC or its licensors. You may not use them without permission.
If you provide suggestions, ideas, or feedback about the Service, you grant Calibra the right to use it without restriction or compensation, provided that we do not identify you publicly as the source without your permission.
The Service may rely on or link to third-party services, including app marketplaces, hosting providers, analytics providers, payment processors, and authentication providers. Third-party services are governed by their own terms and privacy policies. Calibra is not responsible for third-party services that it does not control.
Our Privacy Policy explains how we collect, use, disclose, retain, and protect information.
We aim to provide a reliable and secure Service, but we do not guarantee that the Service will be uninterrupted, error-free, or available at all times. Maintenance, updates, outages, third-party failures, and events outside our reasonable control may affect availability.
You are responsible for maintaining a compatible device, operating system, internet connection, and current version of the Service.
To the maximum extent permitted by law, the Service is provided "as is" and "as available." Calibra disclaims all warranties, express or implied, including implied warranties of merchantability, fitness for a particular purpose, title, non-infringement, and quiet enjoyment.
We do not warrant that the Service or any output will meet your requirements, be accurate or complete, produce a particular result, or be suitable for your circumstances. Nothing in these Terms excludes a warranty or right that cannot lawfully be excluded.
To the maximum extent permitted by law, Calibra and its members, managers, employees, contractors, and licensors will not be liable for indirect, incidental, special, consequential, exemplary, or punitive damages, or for loss of profits, revenue, data, goodwill, or other intangible losses, arising from or related to the Service or these Terms.
To the maximum extent permitted by law, Calibra's total liability for all claims arising from or related to the Service or these Terms will not exceed the greater of (a) the amount you paid Calibra for the Service during the 12 months before the event giving rise to the claim, or (b) US$100.
Some jurisdictions do not allow certain limitations, so some of the above limitations may not apply to you.
To the extent permitted by law, you agree to defend, indemnify, and hold harmless Calibra and its members, managers, employees, contractors, and licensors from claims, damages, liabilities, costs, and expenses, including reasonable attorneys' fees, arising from your User Content, your misuse of the Service, your violation of these Terms, or your violation of another person's rights.
You may stop using the Service at any time. We may suspend or terminate access if we reasonably believe that you violated these Terms, created risk or legal exposure, harmed another person, interfered with the Service, or if we discontinue the Service.
Where reasonably practicable, we will provide notice and an opportunity to resolve the issue. Sections that by their nature should survive termination — including ownership, disclaimers, limitations of liability, indemnification, dispute provisions, and general terms — will survive.
These Terms are governed by the laws of the State of Oregon, without regard to conflict-of-law rules. Subject to any rights you have under applicable consumer-protection law, disputes arising from these Terms or the Service will be brought in the state or federal courts located in Multnomah County, Oregon, and you consent to those courts' jurisdiction and venue.
We may update these Terms from time to time. We will post the updated Terms and change the "Last updated" date. If a change materially affects your rights, we will provide additional notice where required by law. Your continued use of the Service after the updated Terms take effect means you accept the changes.
If a provision of these Terms is held invalid or unenforceable, the remaining provisions will remain in effect. Our failure to enforce a provision is not a waiver. These Terms, together with the Privacy Policy and any additional terms presented for specific features, are the entire agreement between you and Calibra regarding the Service.
You may not assign these Terms or your account without our consent. We may assign these Terms in connection with a merger, acquisition, reorganization, or sale of assets.
